Harley Sears is pleased to announce a management deal with award-winning British fashion designer and musician KEANAN DUFFTY, and signing back on to manage singer-songwriter KRISTEEN YOUNG.

At age 14, Keanan Duffty was a founding member of the British punk band Sordid Details. He later formed Wonder Stories, a New Romantic group influenced by David Bowie and Roxy Music. Keanan is also lead singer in the band Slinky Vagabond, alongside Glen Matlock of The Sex Pistols, Clem Burke of Blondie, and Earl Slick (guitarist for David Bowie).

Kristeen Young is an American singer, songwriter and keyboardist, noted for her aggressive style and four-octave vocal range. Her latest release, V The Volcanic, was recorded with legendary producer Tony Visconti (David Bowie, T. Rex, Morrissey), who also contributed bass and guitar. Musically, the album marks a departure from earlier releases - returning to her roots, and drawing on the electro-funk grooves she loved in her Midwest childhood. Young will support Morrissey on his upcoming tour of South America.

Harley Sears has managed a variety of pop, punk, and rock bands spanning across America and Britain. He studied artist management at Berklee College of Music, and is a member of the Music Manager's Forum.

MMF Supports College Radio Day

“College Radio Day” is the first-of-its-kind and its primary purpose is raise awareness of the importance of college in a time when many college stations are being sold by cash- strapped college and universities. So far, over 220 North American college and high school radio stations have signed on and registered their participation. Each station will produce thematic broadcasts celebrating the college radio medium – Tuesday, October 11th - additional information – www.collegeradioday.com

“We are ecstatic that five weeks out, we have over 220 college and high school radio stations registered for this unprecedented broadcast event, clearly college radio is fighting back” said William Paterson University professor Dr. Rob Quicke (General Manager, WPSC-FM 88.7 – Wayne, NJ.) recently. Dr. Quicke conceived the idea and co- founded the event with Saint Xavier University’s Peter Kreten (GM, WXAV-FM – Chicago, IL.).

“It’s a day we all come together and celebrate the relevance, vast history and importance of college radio in US and Canada. All the stations have pledged to devote their broadcast day, October 11th, to extol the relevance of college radio programming. It is one of the last remaining bastions of creative radio programming. It is free from the constrictions of having to be commercially viable and to this day, takes chances combining daily eclectic cultural, entertainment, sports and educational programming,” Dr Quicke said.

“College Radio Day” will unite stations across North America in a manner never attempted previously. Collectively speaking, college radio is the only free live medium brave enough to play unsigned, local and independent artists and bands on a regular basis. There are hundreds of commercial rock radio stations that feature unsigned talent but their broadcasts are limited to an hour to two a week. College radio does it all day long – 7 days a week and rarely gets the rooted credit for doing so.

A number of colleges of late are considering “selling off their student stations” and this could mean the beginning of the end of college radio as we now know it to be. Scores of mainstream hit-making bands and artists “grew up” and developed their craft and audience with college radio – for example, REM, Death Cab For Cutie, Tom Petty and The Heartbreakers, Pearl Jam, Patty Smith, Arcade Fire, Bare Naked Ladies come to mind.

“College Radio Day” is open to all college and high school radio stations at no cost. The only requirement is to first register and then, showcase your best programming on Tuesday, October 11th. Every station will air a keynote radio feature as well, entitled, “College Radio in 2011: Its Past, Present and Future. It is a 15-minute audio feature delving into how college radio will survive as it progresses in the future. “College Radio is such a significant part of the North American media landscape and we are confident new and un-tuned listeners are just a dial away. College radio doesn’t have advertising budgets or often, wide-spread broadcast transmission due to its core affiliation of being student run and educationally centered. However, once someone tunes in and they hear classical or contemporary music or diverse news and local sports, the audience experiences radio in its purest form,” Dr. Quicke added.

“College Radio Day” is entirely run by a volunteer staff from a consortium of many college radio stations throughout North America. “CRD” was organized due to the fact college radio is often taken for granted and overlooked. It is run by people whose passion for college radio fuels the event. It has been endorsed by Intercollegiate Broadcasting System, Broadcast Education Association, College Broadcasters, Inc. and USA News Network and each are now official supporters of “College Radio Day”.

MMF member managers are encouraged to send us station ID’s from your artists who support College Radio Day to be distributed to all affiliated college radio stations. Please send all station ID’s to Justin@kiqstartmusic.com

A MESSAGE FROM THE PRESIDENT

Message from Barry Bergman, MMF President:

It’s a New Dawn, New Day at the MMF—
Let’s Embrace It!

Ever since our formation in 1993, the MMF has stood for progressive, enlightened approaches to problem solving within our constantly evolving industry. We’ve tackled every challenge with enthusiasm and dedication and I want to take a moment to thank each of you for your unwavering support. We’ve traveled a long road together, but our journey is, in many ways, just beginning...

As we move forward, I want to let you know we’re going to continue our mission with trademark passion, but we’re going to have some new tools at our disposal to help us get our important message out to both our valued membership and the public at large.

Specifically, I’m referring to our newly created interactive web site, designed and built by Craig & Heidi Lyons. It features a private forum, RSS feeds along with FaceBook, LinkedIn and Twitter capabilities as well as up-to-the-minute news from Billboard, Pollstar, The R.I.A.A., ASCAP, BMI, SESAC and others. We’ll be able to communicate with each other, and the world, more effectively—and instantly—than ever. That’s an important key to our continuing to have a significant impact on the creative community we serve.

We’re proudly emphasizing our respected MMF Spotlight and are launching this section with a profile of veteran Paul Geary of Azoff, Geary, Paul & Smith Management. As many of you know, Paul was a key member of the Grammy-nominated band, Extreme, for whom he also cut his management teeth while serving as their drummer. The Boston native was responsible for building Extreme’s national profile which resulted in their 1987 deal with A&M Records.

After his playing days, he refocused his energy on bringing new talent to the world and quickly helped turn Godsmack into a multi-platinum phenomenon that have already earned four Grammy nominations. After folding his Global Artist Management into L.A. based Azoff Music Management (with the legendary Eagles’ manager), he partnered with Jared Paul and has taken Smashing Pumpkins, Creed and Godsmack to dizzying new heights. His management philosophy is enlightened and candidly refreshing: “I work for each artist and take direction specifically from them,” he says. I’m sure our membership will be edified by the comprehensive profile/Q&A of Paul which we present in our new MMF Spotlight.

The MMF wouldn’t have achieved the distinction or success we’ve enjoyed without your help and contributions, so we want to know what’s on your mind—what you’d like to see/discuss on the MMF site. We’re going to highlight your responses to our newly launched MMF Poll and think you’ll agree with us that this section will be viewed as a vital cog in our future growth. And please don’t forget that your dues and important news items are vital to our continued growth.

As part of our expansion, I’m pleased to announce the addition of well respected accountant, Steve Zelin, CPA, and veteran publicist, David Budge of Red Rooster Publicity to our team of pro-bono specialists. Steve will be helping us deal with our fiscal challenges and operating needs. David, a former Editor-in-Chief of Cash Box Magazine, worked for Columbia Records and headed EMI’s Publicity department before opening his own company in 1987. He’s represented Etta James, Taj Mahal, George Thorogood, Fabulous Thunderbirds and John Mayall in addition to a plethora of stars during his record label years (Springsteen, Dylan, Bowie, Red Hot Chili Peppers, etc). Steve and David are excited about assisting MMF members with whatever fiscal management and PR/media needs they may have. Please let me know if you’d like their contact information.

So, it’s with a sense of personal excitement and urgency that I say to all of you, let’s get busy! We have demonstrated our collective strength and proven our capabilities many times, but let’s not rest on our laurels. The next big challenge is coming with the new dawn and we have to be ready for it. Branch Rickey, who was responsible for breaking baseball’s color barrier by bringing Jackie Robinson to the Brooklyn Dodgers said, “Luck is the residue of design.” Let’s re-dedicate ourselves to ensuring that we do everything in our power to establish a climate favorable to making sure the MMF’s luck is good luck.

Sincerely,

Barry Bergman

President, MMF

The apps: Skype, GoogDocs || The user: Justin Seidenberg, owner, Kiqstart Music

By: Steve Hendershot
Justin Seidenberg is accustomed to crises erupting at odd hours. Mr. Seidenberg manages a stable of musicians through his Chicago company, Kiqstart Music LLC, and it's when his artists are at performance venues that they are most likely to require his help. In other words, he needs to be ready for action at 11 p.m. on a Saturday night.“I'm out having dinner with my wife, but my artist gets to the venue and gets into a debate with the production manager. I need be available and prepared,” he says.

Mr. Seidenberg uses two iPhone apps to meet the challenge. The first is Skype, a free app from Palo Alto, Calif.-based Skype Inc. that allows him to video chat with his musicians, wherever they may be.

The second is GoogDocs from Fossil Software LLC of Austin, Texas. This app allows Mr. Seidenberg's mobile phone to access spreadsheets he creates using Google Docs, Google Inc.'s free, cloud-based office suite. He keeps contract details there, such as the set length, sound-check time and financial arrangements between artist and venue, so he can quickly intervene if a dispute arises.

WHY IT WORKS: “A (video chat) app like Skype provides an extra layer of interaction that helps reinforce your message. If you have to air a grievance or a concern, a visual rendering can carry a lot more weight,” says Chris Pautsch, CEO of KeyLimeTie LLC.

SOMETHING ELSE TO TRY: For more formal video conferencing, Cisco Systems Inc. offers a free mobile app for users to join meetings that use the company's WebEx Meeting Center. Mr. Pautsch uses the service at KeyLimeTie to stream video and share documents among participants.

© 2011 by Crain Communications Inc.

Barry Bergman Management Assisting Billy Harvey Transition

(NEW YORK, NY)
Barry Bergman is pleased to announce that client Billy Harvey, the well respected Los Angeles based musician formerly from Austin whose critically acclaimed first four albums established him as an important musical voice is successfully transitioning to acting with starring roles in two upcoming feature films.

Harvey stars in the Mark Dennis/Ben Foster dramatic thriller, “Strings,” a film that has already become a festival sensation, scoring the prestigious Ensemble Award, Audience Award and Best Song nod (for Harvey’s original tune, “The Greatest Escape”) at the Breckenridge Festival of Film in Colorado. For a quick look at the trailer, visit http://stringsmovie.com/.The movie explores the life of a musician (Harvey) who submits to experimental psycho therapy only to discover that part of his transformation involves his becoming part of an extremist vigilante group. Harvey’s “Greatest Escape” is featured on his current CD, “The Everlasting War.”

Harvey’s other featured role is as an Ex-pat in the Spoonbill Pictures dark comedy, “Taiwan Oyster,” directed by Mark Jarrett and shot in part in the exotic capital and other locations on the island. Both films allow Harvey the opportunity to display his impressive dramatic capabilities.

“Strings” will be featured at the White Sands International Film Festival in Las Cruces, NM August 25-28 and at the Tulsa International Film Festival September 22-25.

Commenting on Harvey’s recent activity, Barry Bergman said, “I’ve always known Billy Harvey was a Renaissance artist, capable of succeeding in any field he enters. His work in these two films confirms the belief I’ve had in him from the day we met. He’s a remarkable talent with limitless potential.”

Contact: Barry Bergman at barrybergman@earthlink.net

MMF at CMJ Music Marathon

Music Managers Forum (MMF-US) presented several successful events at this year's CMJ (College Music Journal) Music Marathon in New York City on September 17, 2005. Beginning with two informative management panels educating audiences at Lincoln Center, MMF then held a peer group meeting of managers gathered from around the world, culminating to an evening of live performances at the MMF Showcase at the Lion's Den in Greenwich Village. In the aftermath of MMF at CMJ, several new members have joined the non-profit organization, as MMF has reached out to the greater NYC music community through educational outreach and live performances.

MMF PANELS and PEER GROUP MEETING:

MMF'S board members and panel moderators Steve Garvan (Garvan Management) and Steve Scharf (Steven Scharf Entertainment & Carlin America) represented MMF in presenting two well attended educational panels during CMJ's final day.

Garvan's first panel entitled "Everything You Wanted To Know About Management But Were Afraid To Ask" assembled an impressive array of national and international managers providing useful information of real world experiences for successful management. Panelists included: Jonathan Shalit (Shalit Global), Dougie Souness (No Half Measures Ltd.), Ron Shapiro (Ron Shapiro Management), Tom Sarig (Esther Creative Group) and Pedro Yanowitz of the band Morningwood.

"Everything You Wanted To Know About Management But Were Afraid To Ask" panel

Scharf, now a veteran of putting together CMJ & SXSW panels for the MMF, assembled a group of music and technology expert panelists for the second MMF panel entitled "21st Century Management: New Models, Paradigms and Opportunities" to a standing room only audience at Alice Tully Lobby in Lincoln Center. Panelists included: Tiffany Barsotti (Rowe/AMI Entertainment), Whitney Broussard (Selverne, Mandelbaum & Mintz), Jack Freudenheim of the band 46 Bliss, Dick Huey (Toolshed Inc.) and Mick Wainman (Digital Music Marketing).

"21st Century Management: New Models, Paradigms and Opportunities" panel

After each panel, MMF was successful in disseminating information about
the MMF Educational Series planned for the future, the evening's
MMF showcase at the Lion's Den, and the peer group meeting which took
place during the afternoon. The MMF Peer Group Meeting privately met together with MMF members and music managers gathered from around the world to discuss the organization, its accomplishes, benefits and future plans. Keynote speeches were made by MMF-US President Barry Bergman and the IMMF's Executive Director Michael McMartin from Australia.

MMF LIVE PERFORMANCE SHOWCASE at LION'S DEN:

CMJ highlighted the MMF showcase by making it a 'featured event' in its online and printed materials. At the Lion's Den, MMF kicked off the night with a managers network gathering including an MMF board member
photo shoot. The MMF board then took photos with Crazy James, a teen youth band cultivated by New Yorks's non-profit Road Recovery Foundation.

MMF board and Crazy James, Photo: Stuart Williams

Following a heartfelt introduction by MMF President Barry Bergman who professed his personal support of Road Recovery and its efforts to promote substance free living through the power of music, Crazy James took the stage for a 20-minute set of spirited alternative/pop songs backed by ten teens in recovery supported by music industry professionals touched by substance abuse. The Lion's Den reached capacity proportions for this opening set as the crowd rallied the teen group relishing the spotlight after months of dedicated work on their recovery and musical rehearsals.

Ali & The Electric Insect, an emerging NYC act transplanted from Dallas and Iran, is managed by one of MMF's founding board members Steven Scharf. Ali conjured the spirit of his influences, a mixture of his own musical blend, Led Zeppelin, Cream and Nusrat Fateh Ali Kahn. His 3-piece rock act performed an energetic set that charged the crowd during politically fueled songs and quieted the audience during haunting vocalizations of a mystical, middle eastern nature.

Ali & The Electric Insect, Photo: Stuart Williams

David Berkeley "lustrous and melancholic' voice, as cited by the New York Times, filled the Lion's Den with a set of melodic, introspective and thoughtful songs. Berkeley, managed by longtime MMF board member
Alan Wolmark, presented a bigger sound with a full band in support of his new live release 'Live From Fez'.

The MMF continued its aim to present a live event of diverse artists and musical styles by showcasing veteran singer-songwriter Cindy Bullens who routed to NYC from her European tour to take part in both the CMJ and Boston's NEMO music festivals. Hailing from Nashville, Bullens performed heartrending selections from 'Dream 29' which was released on her own new label LetsPLAY Records, incidentally set-up with help from her Colorado based manager and internationally active MMF board member Steve Garvan.

LA's Fredabla jumpstarted the club with their amalgamation of hip-shaking Latin rhythms, bass-heavy hip-hop beats, streetwise rock riffs, and funky soul grooves. Fronted by passionate vocalist Eric Balfour with support from Charmian Callon on flute & keyboards, "Rooster" on guitar and a full band, Fredalba performed cuts from the forthcoming release 'Uptown Music For Downtown Kids' (Piller Records).

The MMF Showcase included extra late night sets performed by two bands selected by the Music Managers Forum including Philadelphia's The Popo's and popular locals LOURDS featuring the band's namesake female leader who plays virtuoso electric violin, mandolin, electric guitar and sings. LOURDS described their live performance as "we move from pissed off to pensive, from quirky to flirty, from torn to triumphant" in support of their new self releases LOURDS bootleg & Myspace 4-song EP.

Performance Rights Act Public Meeting at Detroit Town Hall

More than 300 artists, radio managers, politicians and members of the public packed the Wayne State University Law Center Auditorium in Detroit on Tuesday (June 2) to hear both sides of the Performance Rights Act and how broadcasters and performers/artists could be affected by the pending House and Senate legislation if passed.

The event, billed as "Awareness for Fairness" and arranged by House Judiciary Committee chairman John Conyers, a Democrat from Detroit, included what's become the usual cast of characters for such public events: Well-worn Motown greats Dionne Warwick, Supremes member Mary Wilson, Martha Reeves, Duke Fakir, Sam Moore and current hip-hop star Rhymefest appeared on the panel in favor of the legislation that would levy fees on broadcasters for airing artists' recordings. While Radio One syndicated host Rev. Al Sharpton did make a brief appearance and spoke about how the legislation would hurt minority broadcasters, other radio management representatives from Radio One, Clear Channel, CBS Radio and Greater Media attended but did not speak. Karole White, head of the Michigan State Broadcasters' Association had been invited by Conyers to attend and speak, but she reportedly informed Conyers' staff that she would be in Chicago.

Reports on the event were mixed. A pro-royalties source told R&R that several members of the public testified that they had come to support broadcasters "but after hearing the testimony of the artists, said they were glad to learn something new" and were now in support of the legislation.

One broadcast source said, "A decision was made by broadcasters not to participate in the forum because of the belief that it would not be a fair venue for discussing the negative impact of a performance tax on Michigan broadcasters and minority stations." The source added, "Conyers promised [Radio One CEO] Alfred Liggins and [chairman] Cathy Hughes a congressional hearing and has not abided by that pledge.... This was a staged event. It was a 'let's bash radio event' created to embarrass radio. It was stacked against us."

MusicFirst spokesman Martin Machowsky disagreed with the broadcaster's assessment: "People who came into the room opposed to the Performance Rights Act left it as supporters of act because they heard both sides of the story. They heard the reasoned position of artist and musicians, and they rejected the blatantly inaccurate messages they have been hearing on the radio.

"And nothing was stacked against them. They were invited before the event. How can they look at themselves in the mirror and make that argument? Their arguments are just over the edge. This is the worst kind of politics."

Recording Arts Day

The hosts of Recording Arts Day

The MMF-US was proud to be one of the host organizations for the 1st Annual Recording Arts Day on Capitol Hill. Recording Arts Day was conceived by the Recording Academy as an industry-wide effort to promote the significant contributions of the recording arts and sciences on our economy and culture. The MMF-US joined with other music industry organizations such as the Recording Academy, Recording Artists Coalition, AFTRA, AFM, National Music Publishers Association and the RIAA to host this event.

Neil Portnow

The day began with a Legislative Breakfast with several Members of Congress where we stressed the importance of the music industry to the US economy and culture, as well as the importance of music education for our children. It was noted that sound recording industries account for more than $15.5 billion in annual revenues, arts and entertainment industries account for 2.6 million jobs, and American copyright industries account for 6% of the nation’s GDP and 4% of the US workforce. In addition, music education has been proven to significantly improve math skills and increase SAT scores by more than 100 points. Several Members of Congress also spoke about the importance of the music industry and music education for children. Each host organization also received a few minutes to describe their organization. I spoke briefly about the work the MMF-US has done with regard to furthering artists’ rights and educating new managers about the intricacies of the music business.

Perry Resnick

After the Legislative Breakfast, we were organized into smaller groups for meetings with specific Members of Congress in their offices. My group included colleagues from Sony BMG, AFTRA and the Recording Academy. We first met with Representative Joseph Crowley, a Democrat whose home district includes parts of Queens and the Bronx and then met with Representative Vito Fossella, a Republican whose home district includes parts of Staten Island and Brooklyn. In these small meetings, we were able to further detail the importance of the music industry to the US economy and the balance of trade, describe how internet piracy has cost Americans tens of thousands of jobs, and again stressed the importance of music education for our children.

Meeting with Representative Joseph Crowley

After lunch, the next program was The Power of Music (to promote music education), hosted by Gloria Estefan. There were several performances with Gloria and various music students from Danville (Ark.) High School, a Grammy Foundation Signature School.

Danville High School music students

Next up were Senate briefings where Sen. Norm Coleman and Sen. Russ Feingold spoke about the importance of the music industry and answered questions from our group.

The crowning event of the day was the Grammy’s on the Hill dinner given by The Recording Academy. The Recording Academy honored Senator Lamar Alexander of Tennessee, Representative Steny Hoyer of Maryland, Gloria Estefan and the Danville (Ark.) High School Music Department. In addition to the usual speeches and a silent auction, there were performances by Jon Secada and Crystal Gayle.

Gloria Estafan

The 1st Annual Recording Arts Day was a resounding success. The MMF-US would like to thank Neil Portnow, Daryl Friedman and April Canter of the Recording Academy for their hard work and dedication in putting this event together.

Hearing on Public Law 106-13 Re:"Works Made For Hire"

Mr. Chairman and members of the Committee, my name is Barry Bergman and I am President of the Music Managers Forum, as well as a personal manager. The Music Managers Forum is an association representing the interests of personal managers and recording artists, with affiliates in 10 countries and branches in many US cities including New York, Los Angeles, Nashville, Seattle, San Francisco, Boston and Washington DC. Our membership consists of individual business people who find, develop, nurture and guide the careers of recording artists, as well as some artists who are self-managed.

We believe these hearings are a major step forward for artists and managers due to the fact that until the formation of the MMF, there was no organization representing the interests of featured artists and managers. Furthermore, we are an organization comprised entirely of volunteers, so we do not have the money to hire high priced attorneys and lobbyists to look after the interests of featured artists and managers.

Therefore, we are grateful to have this opportunity to submit testimony on behalf of featured recording artists and our membership, who fully support the repeal of the recent Copyright Amendment granting work for hire status to sound recordings.

Managers of recording artists have a unique perspective on this issue, as we understand the nature of the recording artist/record company relationship better than most. We effectively balance the interests of art and commerce every day.

It has been noted that this controversial amendment was presented as a "technical correction" to existing copyright law. Our membership feels very strongly that this amendment represents a substantial change to existing copyright law, and that Congress has not been provided with enough information to make an informed decision. Essentially, you have heard only one side of the story. I hope that by presenting the featured artist viewpoint, you will conclude that repeal of the amendment is warranted, and further study and discussion is absolutely essential to fairly protect the interests of performers, while also addressing the concerns of the recording industry.

Other distinguished panelists will provide detailed and varied explanations for why the amendment should be repealed or let stand, while others may address the dubious method by which the amendment was passed. I am going to focus solely on the point that the creations of featured recording artists are not "specially ordered or commissioned works" and that the recent amendment to the copyright law contravenes the intent of Congress when it amended the copyright law in 1976.

Copyright Law is based on the concept that original authorship and ownership results when an artist creates a work. The Copyright Office logo is a circle with a pen stretching through it, touching the other side of the circle, which signifies that copyright protection of the author starts the second the pen touches the page. In the instance of sound recordings, a recording artist is the original author and owner of their performance when it is fixed for reproduction, whether on tape, a compact disc, or as Thomas Edison originally invented, on a metal cylinder.

When the Copyright Act was amended in 1976, Congress recognized that, in certain limited cases, authors might be hired to create certain works, and in that event, the employer would be the author and owner. This is what was intended in the work made for hire provisions of the 1976 Copyright Act.

Congress and the copyright community worked diligently for years trying to define what would be and would not be a work made for hire. The interests of the creators of the works were carefully weighed against the interests of the users of copyrights. Eventually, a course of action was chosen which carved out very defined exceptions to the rule that all works are originally owned by their creator.

Before the recent amendment was passed, there were two alternatives that could designate sound recordings as works made for hire. The first was the traditional employer/employee relationship. The recording industry does not contend this situation exists with featured artists. In fact, virtually all modern recording contracts state explicitly that the artist is not an employee of the record company.

Since this alternative does not apply to featured recording artists, record companies now maintain that sound recordings are "specially ordered or commissioned works," which is the second statutory alternative.

There is simply nothing in law or practice to support the record company contention that a featured artist album qualifies as a work made for hire. A work can only be "specially ordered or commissioned" if it falls into one of nine very specific categories. For example, a work made for hire can be created when a book publisher hires a translator, or a movie producer hires an actor. The key point is that the employer has a choice of who to hire to create the work, and the employer controls most of the creative aspects. By limiting the categories in this way, Congress clearly showed its intent to recognize only very narrowly defined situations where an employer could hire any one of many people to finish a creative process started by the employer. Courts have uniformly upheld this narrow application of the work made for hire principle.

Proponents of this amendment argue that a record is like a motion picture, and since motion pictures are listed as a possible work made for hire, then a sound recording should as well. This is not a proper analogy. The real analogy is between recording artists and book authors. Like a recording artist, the author of a book creates the idea for the book, and starts the creative process well before walking into a publisher's office. A publisher might offer the writer an advance, an editor to work with, cover artwork, manufacturing, distribution and marketing services. These are analogous to the services record companies offer artists. However, a publishing company is not deemed the author of a book, except in very limited circumstances, such as the creation of an encyclopedia.

By declaring that all sound recordings are eligible for work made for hire status, the intent of the 1976 Copyright Law Amendment has been subverted by not carving out these limited exceptions. The vast majority of artists work for years creating their music before a record company ever comes into their lives. Furthermore, record companies do not generally tell artists, especially featured artists, what and how to record, although they may provide guidance regarding marketability. Given these circumstances, we believe classifying sound recordings of featured artists as "specially ordered or commissioned works" is both legally and morally wrong.

We believe that managers and artists everywhere are willing to work with Congress and the Recording Industry to carve out limited exceptions that better fit into the work made for hire situation, taking into consideration the spirit of the original law and the economic concerns of the recording industry. We ask that you repeal this amendment, and let us have a negotiation where all interested parties are present and accounted for. Then, and only then, will Congress have the opportunity to consider legislation which is fairly negotiated and reflects the concerns of everyone affected by the change.

Thank you very much for your consideration.
